1. Agreement to Terms
By downloading, installing, or using the Vires Fit Club mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Vires Fit Club ("we," "our," or "us"), not with Apple Inc. or Google LLC. Apple and Google are not parties to this agreement and bear no responsibility for the App or its content.

2. Eligibility
You must be at least 13 years of age (or 16 in the European Economic Area) to use the App. By using the App, you represent and warrant that you meet this age requirement.
If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
The App is not a medical service. If you have any health conditions, injuries, or concerns, consult a qualified healthcare professional before beginning any fitness program.
3. License to Use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for your personal, non-commercial use.
This license does not allow you to:
- Copy, modify, or distribute the App or any of its content
- Reverse engineer, decompile, or disassemble the App
- Remove any proprietary notices or labels on the App
- Use the App for any commercial purpose or on behalf of a third party
- Transfer the App or your rights under these Terms to another person
4. User Accounts
To access certain features of the App, you must create an account using Apple Sign In or Google Sign In. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately at viresclub@gmail.com if you suspect unauthorized access
We reserve the right to terminate or suspend your account at our discretion if you violate these Terms.
5. User-Generated Content
5.1 Your Content
The App allows you to upload photos, post workout updates, write comments, and interact with other users ("User Content"). You retain ownership of any content you create.
By submitting User Content, you grant Vires Fit Club a worldwide, non-exclusive, royalty-free, sublicensable license to use, store, display, reproduce, and distribute your content solely for the purpose of operating and improving the App.
5.2 Content Standards
You agree not to post content that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, or obscene
- Infringes any third party's intellectual property or privacy rights
- Contains nudity, graphic violence, or sexually explicit material
- Promotes dangerous or illegal activities
- Constitutes spam or unsolicited commercial messages
- Impersonates any person or entity
5.3 Moderation
We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful to users or the community. We are not obligated to review all content but may do so.
5.4 Reporting
If you believe content posted by another user violates these Terms, use the in-app report feature or contact us at viresclub@gmail.com.
6. Subscriptions and Payments
6.1 Free and Premium Features
The App offers both free features and premium features available through a paid subscription ("Premium").
6.2 Subscription Billing
Premium subscriptions are offered on a recurring basis (monthly or annually). By purchasing a subscription, you authorize us (through Apple App Store or Google Play) to charge your payment method on a recurring basis until you cancel.
Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the renewal date.
6.3 Pricing
Current pricing is displayed in the App at the time of purchase. Prices may vary by region and are subject to change with advance notice.
6.4 Free Trials
If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends.
6.5 Cancellation
- iOS: Cancel via Settings → Apple ID → Subscriptions → Vires Fit Club
- Android: Cancel via Google Play Store → Subscriptions → Vires Fit Club
Cancellation takes effect at the end of the current billing period. You retain access to Premium features until then.
6.6 Refunds
All purchases are processed by Apple or Google. Refund requests are subject to their respective refund policies:
We do not process refunds directly. Contact Apple or Google support for refund requests.
6.7 Price Changes
We may change subscription prices at any time. If we increase your subscription price, we will notify you in advance and your continued use of the subscription after the price change constitutes your agreement to the new price.
7. AI Coach Feature
The AI Coach provides personalized workout recommendations based on your fitness data. You acknowledge that:
- AI-generated recommendations are for informational purposes only and do not constitute medical or professional fitness advice
- You use AI Coach features at your own risk
- You must explicitly consent to AI data processing before using this feature
- We do not guarantee the accuracy, completeness, or suitability of AI-generated content for your specific circumstances
Always consult a qualified fitness professional or healthcare provider before making significant changes to your exercise routine.
8. Intellectual Property
All content in the App not created by users | including but not limited to workout programs, exercise library content, graphics, logos, text, and software | is owned by Vires Fit Club or its licensors and is protected by intellectual property laws.
You may not use, copy, reproduce, or distribute any Vires Fit Club intellectual property without our prior written consent.
If you believe your intellectual property rights have been infringed, contact us at viresclub@gmail.com with details of the alleged infringement.
9. Prohibited Conduct
You agree not to:
- Use the App in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to any part of the App or its related systems
- Use automated tools (bots, scrapers) to access or collect data from the App
- Interfere with or disrupt the integrity or performance of the App
- Harass, bully, or intimidate other users
- Create multiple accounts to evade a ban or suspension
- Upload malicious code or attempt to compromise the App's security
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure
- Any defects will be corrected
- Results obtained through the App will be accurate or reliable
- The App is free of viruses or other harmful components
Apple and Google make no warranty with respect to the App whatsoever.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Vires Fit Club, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits or revenue
- Loss of data
- Personal injury or property damage arising from your use of the App
- Unauthorized access to or alteration of your data
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or €100 (whichever is greater).
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, where such exclusion is prohibited by law.
12. Indemnification
You agree to indemnify and hold harmless Vires Fit Club and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your User Content
- Your violation of these Terms
- Your violation of any third party's rights
13. Third-Party Links and Services
The App may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of third-party services. Your use of third-party services is at your own risk and subject to their terms.
14. Termination
14.1 By You
You may stop using the App and delete your account at any time from your profile settings.
14.2 By Us
We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe:
- Violates these Terms
- Is harmful to other users, third parties, or us
- Is required by law
Upon termination, your license to use the App ceases immediately. Sections 8, 10, 11, 12, and 15 survive termination.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of Turkey, without regard to its conflict of law principles.
Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts of Turkey.
For EU/EEA users: Nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.
16. Apple-Specific Terms
If you downloaded the App from the Apple App Store, the following additional terms apply:
- These Terms are between you and Vires Fit Club only, not Apple.
- Apple has no obligation to provide maintenance, support, or warranty for the App.
- Apple is not responsible for addressing any claims relating to the App or your use of it, including product liability claims, consumer protection claims, or intellectual property infringement claims.
- Apple has no obligation to investigate, defend, or resolve any third-party claim that the App infringes a third party's intellectual property rights.
- Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.
- You must also comply with Apple's applicable third-party terms of service when using the App.

17. Google-Specific Terms
If you downloaded the App from Google Play, the following additional terms apply:
- These Terms are between you and Vires Fit Club only, not Google LLC.
- Google has no obligation to provide maintenance, support, or warranty for the App.
- Google is not responsible for addressing any claims relating to the App or your use of it.
- You must also comply with Google Play's Terms of Service when using the App.

18. Changes to These Terms
We may update these Terms from time to time. When we do, we will:
- Update the "Last Updated" date at the top of this document
- Notify you via push notification or in-app message for material changes
- Require re-acceptance where required by law
Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
19. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vires Fit Club regarding the App.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
- No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
- Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
